Terms of service
1. Overview
These Terms of Service ("Terms") govern your access to and use of SketchPort, including our website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date below and, where appropriate, provide additional notice. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements and that all information you provide to us is accurate and complete.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account.
4. Acceptable Use
You agree not to engage in, facilitate, or encourage any of the following activities while using the Service:
- Any activity that violates applicable local, national, or international law or regulation;
- Harassment, bullying, threats, intimidation, or abuse directed at any person;
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity;
- Attempting to gain unauthorized access to the Service, other user accounts, or our systems and networks;
- Interfering with, disrupting, or placing an undue burden on the Service or its infrastructure.
Accounts associated with any of these activities may be suspended or permanently deactivated at our sole discretion.
5. User Content
You retain ownership of the drawings, comments, and other materials you create or submit through the Service ("User Content"). By submitting User Content, you grant SketchPort a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating, promoting, and improving the Service.
You are solely responsible for your User Content and represent that you have all rights necessary to submit it. The following types of content are prohibited on the Service:
- Hate speech or content that promotes discrimination, bigotry, or violence against individuals or groups;
- Pornographic, sexually explicit, or otherwise obscene material;
- Content that infringes the intellectual property or other rights of any third party;
- Spam, unsolicited advertising, or other deceptive or fraudulent material.
We reserve the right, but assume no obligation, to review, remove, or restrict access to any User Content that violates these Terms. Repeated or serious violations may result in deactivation of your account.
6. Privacy
We respect your privacy. We do not sell your personal data, and we do not share your personal data with third parties except as necessary to operate the Service or as required by law.
Your drawings may be used to promote and advertise SketchPort unless you opt out on the settings page. Where we rely on third-party service providers to deliver the Service, those providers are bound by obligations consistent with this section.
7. Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by SketchPort and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we reasonably believe your conduct may cause harm to other users, third parties, or SketchPort. Upon termination, the rights and licenses granted to you under these Terms will cease.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, SketchPort disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, SketchPort and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.
